Here are our policies and terms outlined below. By completing a vendor application, purchasing a ticket, or participating in a Colorful Desires event, you confirm that you have read, understood, and agreed to these policies and terms. Failure to comply may result in removal from the event without refund or future participation opportunities.
Vendor Event Policies and Terms
Refund Policy

Non-Refundable Payments:

All payments made to secure a vendor spot are considered final deposits and are non-refundable.

Refunds:

Refund requests are reviewed on a case-by-case basis and may take 5-7 business days to process if approved.

Credit Option:
-
Vendors who cancel may be offered a credit toward a future event. Credits can be applied to an event at the same mall or a different mall.

If there are price differences between the original event and the new event, vendors will be responsible for paying the difference.

Credits must be used within 6 months of the original event date.

Transferability:
-
Vendor slots are transferable but must be pre-approved by Colorful Desires.
-
Both the original vendor and the prospective replacement vendor must contact ColorfulDesires2020@gmail.com for approval. Transfers are not guaranteed and will be approved at the discretion of the event team.

Event Cancellations by Colorful Desires:

If an event is canceled or postponed by Colorful Desires, vendors will be offered the option of a credit toward a future event or a full refund, depending on the circumstances.

No-Shows:
-
Vendors who do not attend their scheduled event without prior notice will not be eligible for a refund or credit.

Approval Requirement:
-
Vendors are required to receive an official approval email from Colorful Desires to participate in any event. Simply purchasing a vendor ticket does not guarantee entry into the event. Vendors who arrive without prior approval will not be permitted to set up or vend.

Public Attendance:
-
Tickets sold by Colorful Desires are exclusively for vendors. Mall events are free to the public to attend.

Traffic Flow Disclaimer:
-
Colorful Desires does not guarantee a specific level of foot traffic or sales for any event, as each event is unique and traffic flow can be unpredictable.
-
However, we maintain our commitment to integrity by actively advertising and promoting the event to attract shoppers to the area.

Payment Terms
-
Payment Deadlines:
-
All payments for vendor tickets must be made in full at the time of purchase. There are no partial deposits or payment plans available.

Accepted Payment Methods:
-
Payments are accepted via [specific methods, e.g., credit/debit card, PayPal].
-
Cash payments are not accepted, unless otherwise specified in the event details.
-

Refund Timeline:
-
Approved refunds (in the event of cancellation by Colorful Desires or the venue) will be processed within 5-7 business days after approval.

Event Ticket Selection:
-
The event ticket may display the entire event date range (e.g., two or more days); however, vendors should be aware that different days may have separate prices and availabilities.
-
Your ticket selection at checkout will determine your reserved day(s), and that selection will be respected and recognized for the event. Vendors must verify their ticket details during purchase to avoid confusion.

Extending or Downgrading Tickets:
-
Vendors who purchase a single-day ticket and wish to extend to a second day must email ColorfulDesires2020@gmail.com to request the extension. This is subject to availability.

Vendors are not allowed to downgrade their ticket from 2 days to 1 day. Vendors unable to attend must notify Colorful Desires in advance to avoid losing their opportunity to vend at future events.

Early Bird Tickets:
-
Early Bird tickets are offered in three batches, each with specific discounts based on time sensitivity or limited quantities:
-
First Batch: Offers the biggest discount and is available for a limited time or quantity.
-
Second Batch: Provides a smaller discount once the first batch is sold out or expired.
-
Final Batch: Tickets are sold at the standard price once Early Bird discounts are no longer available.

Event Ticket Availability:
-
Tickets are sold on a first-come, first-served basis and must be purchased online through the provided platform. No reservations or holds will be made without full payment.

Price Adjustments:
-
If a vendor uses a credit toward a future event with a higher fee, the vendor is responsible for paying the price difference.
-
No refunds will be issued if the future event has a lower fee.
-

Overdue Payments:
-
If payment is not successfully completed at the time of registration due to insufficient funds or other issues, the vendor's spot will not be held, and the vendor must reapply.

Receipts and Confirmation:
-
Vendors will receive a receipt and confirmation email upon successful payment. If you do not receive confirmation within 24 hours, please contact ColorfulDesires2020@gmail.com.

Discounts and Promotions:
-
Discounts or promotional offers, if available, must be applied at the time of purchase. Retroactive discounts will not be honored.

Chargebacks or Payment Disputes:

Vendors who initiate a chargeback or payment dispute without prior communication with Colorful Desires will forfeit their vendor spot and be prohibited from participating in future events.

Vendor Requirements

Application and Approval:

All vendors must complete an application and receive an official approval email from Colorful Desires before participating in any event. Purchasing a vendor ticket does not automatically guarantee approval.

Setup and Breakdown:
-
Vendors must arrive 1 hour before the mall opens to set up their booths.
-
Tardiness Policy: Vendors who are late to the event will forfeit their ability to vend that day, with no refund.
-
Breakdown should begin 1 hour before the mall closes; however, vendors may sell up until the final minute. Vendors must start packing up before the mall closes as a courtesy to mall operations.

Vendor Space:

Vendors must remain within their assigned 8' x 8' booth space. Vendors may not remove the table cover provided, but they are allowed to place their own cover on top.

Dollies and wagons must be returned to the vehicle after setup and cannot remain at the booth.

Holiday-Specific Policies:

Increased Pricing: During the holiday season, vendor fees may be higher than usual due to increased demand and premium mall traffic.

Simplified Setup Expectations: Clean, efficient table setups are required due to space constraints.

Cleanup and Departure:

Vendors must clean up all trash and fold chairs before leaving.

Marketing and Promotion Policy

Vendor Consent:

By submitting a vendor application, vendors grant Colorful Desires permission to use their business name, logo, and photos for promotional purposes.

Vendor-Provided Materials:

Vendors are encouraged to provide logos, business descriptions, or product photos to maximize promotional opportunities.

Event Promotion:

While vendor promotion is a priority, it is not guaranteed and may vary based on resources and schedules.

Vendor Collaboration:

Vendors are encouraged to share event details with their networks to boost visibility.

Prohibited Items and Activities

Prohibited Items:

Vendors may not sell:

X-rated materials, weapons, drugs, alcohol, or counterfeit goods.

Prohibited Activities:

Vendors may not sublet booth spaces or engage in disruptive sales tactics.

Liability and Indemnity

Vendor Responsibility:

Vendors are responsible for their own property.

Indemnification:

Vendors agree to indemnify Colorful Desires from any claims arising from their participation.

Privacy Policy

Colorful Desires collects personal information from vendors through the vendor applications for each event. This may include:

Payment information

Use of Information:

The information collected is used for the following purposes:

To communicate event details, updates, and changes.

To process payments and issue receipts or refunds.

To include vendor names, business names, or logos in promotional materials (with prior approval).

To maintain records for internal reporting, planning, and future booking opportunities.

Consent:

By completing a vendor application or purchasing a ticket, vendors agree to allow Colorful Desires to store their information in our database for future bookings or event opportunities.

Vendor Rights:

Vendors may request to:

Update or correct inaccuracies.

Delete their information from our database (except when retention is required by law).

Vendor information will be retained for up to 12 months after the last event attended or as required by law. Vendors may request deletion of their information at any time by contacting ColorfulDesires2020@gmail.com.

While Colorful Desires primarily operates in the U.S., we aim to align with privacy standards such as the General Data Protection Regulation (GDPR) and the California Consumer Privacy Act (CCPA):

Vendors have the right to know how their data is used, access their stored information, and request its deletion.

Vendors will not be penalized for exercising their privacy rights.
